**DEBTS RECOVERY TRIBUNAL, DEHRADUN**

**M.A. No. 81 of 2024**

**Bhushan Kumar & Ors. Vs. Central Bank of India**

**Date: 26.11.2025**

**Order/judgement**

The Applicant has submitted that the amount as per settlement has already been paid finally in the month of August, 2025. The date of deposition has been submitted by the parties is different, but there is no controversy about repayment of amount as per award passed in Lok Adalat on 09.03.2024.

The respondent bank has prayed for interest in relation to delay period @12%. On the other hand, the Applicant has submitted calculation @8% in decreasing manner and total amount has been mentioned in relation to interest of Rs.99,791/- (Rupees Ninety Thousand Seven-Hundred Ninety-One only). The respondent bank has not submitted any calculation in relation to interest.

But in the opinion of the Tribunal, it shall be appropriate for both the parties the rate of interest is considered @10% simple interest per annum and amount of interest for delay period is to be paid Rs.1,25,000/- (Rupees One Lacs Twenty-Five Thousand only) in round figure.

In the opinion of the Tribunal, it shall be expedient that the Applicant shall repay Rs.1,25,000/- (Rupees One Lacs Twenty Five Thousand only) in relation to interest for delay period within a period of 30 days from the date of this order.

In the light of above observation, this petition is disposed of accordingly.

Interim order, if any, vacated. All interim applications are disposed off accordingly.

Record be consigned.
