ORDER

The applicant was discharged from service on 30.11.2023. He was in a permanent low medical category on account of disabilities of (a) ‘Obesity’, the extent of which was assessed to be 05% for life but neither attributable to nor aggravated by military service and (b) ‘Hypertension Stage-2’, extent of which was assessed to be 30% for life but neither attributable to nor aggravated by military service. In respect of disability (b), the assessment was made as neither attributable to nor aggravated by military service because onset of the disability was in a peace area. Thus, the claim for grant of disability element has been rejected .

Learned counsel for the applicant confines his claim to grant of disability element for disability of ‘Hypertension Stage-2’ only. His submission is that merely because the onset of the disability was in a peace areas, it could not have been assessed to be neither attributable to nor aggravated by military service.
