ORDER

The applicant was discharged at his own request on 01.08.2016. Total service rendered by him was 05 years , 04 months and 26 days . He was in a permanent low medical category on account of disability of ‘Fracture L5 B/L PARS’, the extent of which was assessed to be 20% for life and attributable to military service. Accordingly, he was granted disability element only. The claim for grant of service element, however, has been rejected on the ground that discharge was at own request and was not a case of invalidment.

Learned counsel for the applicant has relied upon Government of India Policy dated 19.05.2017 to submit that the applicant was entitled to grant of disability pension, even if, his discharge was at own request. Thus the rejection of the claim was not justified. Notice. Mr. Jagjot Singh Lalli, Dy. Solicitor General of India accepts notice on behalf of the respondents and waives service and seeks time to file reply.

Adjourned to 07.04.2027.
