This Miscellaneous Application No. 10 of 2024 has been filed by the applicant on 08.01.2024 with the prayer for restoration of S.A. No. 338 of 2023.
The Securitization Application was dismissed on 02.01.2024, in non-compliance as well as in non-payment of amount by the applicants as directed by the Tribunal, and the application for restoration with the said order has been filed by the applicant bank on 08.01.2024.
The applicant has already deposited more than 25% amount as per demand notice after dismissal of the Securitization Application and it is admitted by Ld. Counsel for Respondent F.I. Respondent F.I. as also shown no any objection in relation to settlement of the matter as per order dated 29.01.2024 passed by the Tribunal and the prayer for restoration of the Securitization Application No. 338 of 2023 was allowed on 29.01.2024.
Hence allowed and the Securitization Application No. 338 of 2023 M/s Uvesh Enterprises Vs. Jammu and Kashmir Bank Ltd. is restored to its original number.
M.A. No. 10 of 2024 is disposed off accordingly.
As none appeared today on behalf of Respondent F.I., once more opportunity is provided to the Respondent F.I for appearance.
