Mehar Chand & Anr. Vs. Punjab National Bank & Anr.
Present: Shri Gautam Kumar, counsel for the appellant, Shri S. K. Srivastava, counsel for the respondent-Bank, The office report dated 23.07.2026 shows that no better affidavit in support of the delay condonation application has been filed by the appellant inspite of earlier order dated 16.04.2026. Accordingly, their right to file better affidavit stands closed.
Perusal of record shows that the delay is of two months in filing the present appeal and no specific date of receiving of certified copy of the order impugned has been mentioned in para 4 of the delay condonation application. Thus, the cause shown in the application for condonation of delay is not sufficient, therefore, the application for condonation of delay is dismissed. Consequently, the appeal is also dismissed being barred by limitation.
