IN THE DEBT RECOVERY APPELLATE TRIBUNAL AT CHENNAI
IA 342/2025 (Delay) in A.IR:2020/2024
G R Padma Shree V/S Union Bank Of India & Ors 15/09/2026
This application is filed for condoning the delay of 146 days in filing the appeal. Learned counsel for the petitioner that after the order was pronounced in SA 364/2021, a copy application was filed, and it was made on 08.07.2024. The petitioner was not able to contract the counsel for the petitioner for more than a month. She contracted other counsel regarding the next steps to be taken. She was suggested to approach the Hon’ble High Court and then she approached the Tribunal and also her son met with an accident. Being a single woman and taking care of her son, she could not take steps for filing this appeal. These factors contributed the delay of 148 days in filing the appeal. Learned counsel for the first respondent strongly opposes this application stating that the reasons stated cannot be treated as true and thus, the same cannot be accepted. Learned counsel for R3 is also submitted that the reasons are not justifiable and acceptable. In view of the reasons stated for the delay in filing the appeal and with a view to give an opportunity to the appellant to prosecute the appeal, this Tribunal is of the view that the delay of 146 days in filing the appeal can be condoned subject to payment of costs of Rs.2,000/- to the DRT & DRAT Bar Association on or before 29.09.2026. Post the matter on 01.10.2026 for reporting compliance.
