IN THE DEBT RECOVERY APPELLATE TRIBUNAL AT CHENNAI

M.A:169/2017

Hudco Ltd V/S M/S.Good Homes Pvt Ltd

09/09/2026

Heard the submissions of the learned counsel for the parties. One of the grounds raised by the learned counsel for the respondent in MA 169/2017 viz., M/s. Good Homes Pvt. Limited is that M/s. Good Homes Pvt. Limited is neither a borrower nor a guarantor, but, offered its property for mortgage and therefore fastening liability especially, personal liability against the respondent-M/s. Good Homes Pvt. Limited, is against the Law. Another aspect canvassed is that the order to pay post order interest at the rate of 18.5% p.a. is excessive and unjustifiable. Therefore, Registry is directed to call for original records from the DRT-I, Ernakulam especially the records filed by the applicant before the Tribunal for proving the claim made in the OA 42/2001. Post the matter on 21.10.2026.
