IA 368/2021 (Delay) In A.IR:68/2021

Roger Mathew V/S Ao, South Indian Bank & Ors.

16/09/2026

Learned Counsel for the Petitioner/Appellant and R1&R2 Bank is present. No representation for other Respondents.

This appeal is filed against the dismissal of SA No. 141 of 2014 filed to set aside the possession notice issued under Section 13(4) of the SARFAESI Act, 2002. After disposal of this Securitization Application, this appeal is filed with a delay of 520 days.

It is noticed that at least six months was available prior to the onset of COVID 19 pandemic for the Petitioner to file this appeal, however, the appeal was not filed on time. It is informed by the Learned Counsel for the Petitioner that subsequent sale was held and that was challenged.

Therefore, Petitioner is directed to produce relevant records with regard to the challenge made to the sale held and the orders passed by the DRT.
