IN THE DEBT RECOVERY APPELLATE TRIBUNAL AT CHENNAI

Misc. Appln. 78 & 79/2025 & IA 1683/2025 in R.A(S.A):19/2020

Dwarkanath Prabhu V/S The A.O., State Bank of Mysore 07/09/2026

Learned Counsel for the appellant and R4 & R5 are present.

This application is filed for condoning the delay of 579 days in filing the restoration application, for restoring RA (SA) 19 of 2020, which was dismissed on 8.3.2024 for non-prosecution, rather not taking steps for substituting State Bank of India in place of State Bank of Mysore.

Learned Counsel for the Appellant submitted the Junior Counsel, dealt with this case, left the officer due to family problems in June, 2024 itself without informing about the status of this case, and that Appellant came to know about the dismissal only upon enquiry from the Junior Counsel about the status of the appeal, subsequently. So, this contributed to the delay of 579 days in filing this restoration application.

Despite service of notice to R1 & R2, none appeared.

Learned Counsel for R4 & R5 submits that State Bank of Mysore is now merged with State Bank of India and there is an application pending in IA 1683 of 2025 filed for substitution by the Appellant.

In the said circumstances, this Tribunal allows IA 1683 of 2025, filed for substituting State Bank of India in place of State Bank of Mysore, and directs the Appellant to make appropriate amendment in Miscellaneous Application No.78 of 2025 (Delay in Restoration) and Miscellaneous Application No.79 of 2025 (Restoration).

Post the matter on 7.10.2026 for reporting compliance, and further proceedings.
