IN THE DEBT RECOVERY APPELLATE TRIBUNAL AT CHENNAI

RA (SA) 70/2026

K R Sabarish V/S Canara Bank & Anr

01/09/2026

RA (SA) 59/2025 & RA (SA) 70/2026 :

Learned Counsel for both sides are present.

Both the appeals are filed against the order of disposal in an application filed for condoning the delay in filing the securitization applications, as prescribed under Section 17 of the SARFAESI Act, 2002. It is a settled proposition of law that Tribunals are not Court, and they have no powers to condone the delay in filing the applications beyond the period of limitation under Section 17 of the SARFAESI Act, 2002 before the Tribunal. Thus, the scope of these appeals is very limited. Therefore, post both these appeals on 7.10.2026, as a last chance, under the caption ‘part heard – issue of limitation’. No further adjournments will be given.
