IN THE DEBT RECOVERY APPELLATE TRIBUNAL AT CHENNAI
R.A(S.A):99/2026
Nisar Ahamed V/S Indian Bank
10/09/2026
Learned Counsel for both sides are present.
Heard the submissions of the Learned Counsel appearing for the parties in the application filed for receiving additional documents in IA 1251 of 2026. The additional documents sought to be filed are as follows:
a) Order passed by the Hon’ble High Court of Judicature at Madras in WP No. 18440 of 2022.
b) Objection letter issued by the Respondent / Appellant to the Petitioner Bank.
c) Reply letter issued by the Petitioner Bank to the Respondent.
It is the submission of the Learned Counsel for the Petitioner/Respondent Bank that Appellant filed WP No. 18440 of 2022 before the Hon’ble High Court of Judicature at Madras seeking a writ of Mandamus against the sale of the property. When the writ petition was heard, permission was sought for withdrawal of the writ petition with an opportunity to give reply/ objections to the demand notice issued under Section 13(2) of the SARFAESI Act, 2002. Giving such a liberty, the writ petition was dismissed. Thereafter, Appellant sent objections to the demand notice on 8.8.2022. On receiving the objections, the Bank sent a reply dated 23.8.2022 to the Appellant. Only these documents are sought to be produced as additional documents.
Learned Counsel for the Appellant objected to this application on the grounds that the time for production of these documents is already lost.
Considered the rival submissions and perused the records.
Admittedly, these three documents sought to be produced are concerning the parties in this appeal. These documents are essential and required for the appropriate and right adjudication of the issues involved in this appeal.
Therefore, IA 1251 of 2026, filed for receiving additional documents, is allowed.
Orders already reserved in the main appeal.
