IN THE DEBT RECOVERY APPELLATE TRIBUNAL AT CHENNAI

IA 1033/2026 (Urgent) in IA 1034/2026 (Delay) In A.IR:1011/2026

Central Bank of India & anr V/S M/s Borg Energy India P ltd & 3 ors 10/09/2026

Considering the reasons stated in the affidavit filed in support of the application, this urgent application is allowed. IA 1034/2026 (Delay): When the matter is taken up, it is informed by the learned counsel for the petitioners that the postal notice taken to R1 returned with an endorsement “ left without instructions” and notice taken to R2 to R4 returned with an endorsement “no such persons”. Even after taking paper publication for the respondents, none appeared. This application is filed for condoning the delay of 100 days in filing this appeal. Learned counsel for the petitioners submitted that after the disposal of the SA 64/2016 on 24.11.2025, the appellant-Bank has to follow some internal procedures including obtaining legal opinion, administrative approval and sanction from the competent authorities before initiating the appeal proceedings, which contributed the delay and the delay is neither wilful nor wanton. Thus, he prays for condoning the delay in filing the appeal. As already stated, there is no representation for the respondents. In view of the reasons stated in the affidavit and having satisfied with the reasons for the delay, the delay 100 days in filing this appeal is condoned and this application is allowed. Registry is directed to number the appeal, if it is otherwise in order and list the same on 23.10.2026 for hearing, after completion of service, if any pending and pleadings.
