This application is filed for modifying the order passed in RA (SA) 101 of 2013 whereby this Tribunal directed the Respondent Bank to collect the pre-deposit deposited with the Registrar of this Tribunal and to deal with it according to law. By this application, it is prayed that the order dated 5.9.2017 may be modified to the limited extent of directing the refund of statutory pre-deposit amount deposited by the Applicant and to refund the pre-deposit amount to the applicant, along with accrued interest, if any, and to pass such further or other orders as this Tribunal deems fit.
The proceedings of the Learned Registrar, DRAT, Chennai shows that despite appearance by M/s. V. Jayachandran Associates on behalf of the Respondent before the Tribunal, and getting time for filing counter, the counter is not filed on 6.8.2026 and 13.8.2026. Therefore, this matter is put up before this Tribunal today.
Since the matter is listed before this Tribunal for the first time today, this matter is again posted for filing counter on behalf of the Respondent by 16.9.2026, as a last chance. Failing to file counter would result in passing appropriate orders in the application. Registry is directed to verify the status of the pre-deposit made in this appeal as to whether it is still available with the Registry, DRAT, Chennai or dealt by the Bank, as ordered by this Tribunal on 5.9.2017 in RA (SA) 101 of 2013.
