O R D E R (ORAL) (HON’BLE DR. K.B. SURESH, MEMBER (J)

Applicant seeks that he may be granted promotion to Staff Car Driver. Respondents objects to it saying that this is a very small department and therefore all the drivers are called only Drivers and not Staff Car Drivers. They would say that the Staff Car Drivers scheme is not applicable to this particular department and in the earlier occasion, based on our order, they had granted him Grade II payscale only and not a benefit under the scheme. Even that also they have done with the approval of the competent authority. They would say that the office work is being carried on by pooling the other two drivers also along with the applicant and they had agreed for grant of MACP to them in furtherance of the scheme of MACP and there cannot be any promotional role for drivers in such a small department.

2. Besides that, applicant is the juniormost and, if anyone is to be promoted, it is the senior people who are above him and who had gracefully and graciously accepted the MACP.

3. Therefore, there is no merit in the contentions of the applicant. The OA is dismissed. No order as to costs.
