CENTRAL ADMINISTRATIVE TRIBUNAL JODHPUR Order Sheet Item no.: 3 O.A./252/2026 (JODHPUR) [ SELECTION / RECRUITMENT ] Court No.: 1 No of Adjournment: Order Dated: 08/10/2026 MANISH KUMAR Vs KVS-NVS

For Applicant(s) Advocate : Mr. M S Godara For Respondent(s) Advocate : Mr. K S Yadav Order of The Tribunal On receipt of an advance copy of the OA, Mr. K S Yadav appears on behalf of the respondents. Heard learned counsel for the applicant and perused the material available on record. Learned counsel for the applicant submits that the applicant has not been allowed to appear in interview/viva voce holding him ineligible for the post i.e. TGT (Special Education) on account of issuing the OBC certificate after the last date of application i.e. 03/12/2025. Learned counsel for the applicant submits that he has strong grounds to assail the order passed by the respondents in not allowing him to appear in the interview/viva voce on basis of judgment passed by the Hon'ble Delhi High Court in the matter of Ravi Kumar Vs All India Institute of Sciences (W.P(C) 15514/2023) and the Principal Bench order dated 07.10.2026. passed in OA No. 3789/2026 along with connected matters. Since the interviews are to be completed on 13/10/2026, the applicant may be allowed provisionally appear in the interview for the post of TGT (Special Education). On the contrary, learned counsel for the respondents submits that no cause of action has arisen within the territorial jurisdiction of this Bench. Therefore, the applicant cannot invoke the jurisdiction of this Bench on the basis of his residence within the territorial jurisdiction of this Bench. Counsel for the applicant while relying on the judgment of Hon'ble Rajasthan High Court in the matter of Bajrang vs. KVS & Ors. (D.B. Civil Writ Petition No.24344/2025), submits that since the application was submitted online from Hanumangarh, the Jodhpur Bench of CAT has jurisdiction to entertain the present OA. After arguing at some length, learned counsel for the applicant seeks permission to withdraw this OA with a liberty to file it before the Bench having jurisdiction to entertain the same. However, learned counsel for the applciant prays that since interview is still going on, the applicant may be allowed provisionally to participate in the interview/viva voce. In view of the above, while granting permission to withdraw this OA with liberty to file it before the competent Bench having jurisdiction to entertain the OA within a period of 10 days from today, we direct the respondents to allow provisionally the applicant to participate in interview/viva voce, if already not concluded as on date. It is made clear that it will not create any right in favour of the applicant for selection/appointment on the post of TGT (Special Education).

Office is directed to return the Original Application to the applicant immediately after keeping a copy of the same on record.
