Per:- Justice Narendra Kumar Johari, Member (Judl.) :-

Shri N.N.Singh, counsel for the applicant and Shri Rabindra Kumar Choubey, Addl. Standing Counsel for opposite parties are present.

Counsel for opposite parties submits that the sole relief prayed for by the applicant in the instant OA is to direct/command the concerned respondents/Appellate Authority to dispose the appeal within the stipulated period. He further submits that the applicant had preferred an appeal dated 30.05.2025 against the impugned order dated 21.04.2025 which has been rejected by the Appellate Authority vide Memo No. Vig/PN/AP-46/MTH/2025,dated 16.09.2026 Digitally signed by S K JHA DN: CN=S K JHA, E= sudhir.kmr12@gov.in Reason: I attest to the accuracy and integrity of this document Location: Date: 2026.10.15 12:35:51+05'30' Foxit PDF Reader Version: 2025.3.0 S K JHA

and the above fact came into knowledge of applicant just today when the counsel for opposite parties in compliance of order dated 29.09.2026 communicated the above fact. As such, there is no need to proceed with the OA and the same be dismissed as having become infructuous. The main and only relief in this OA was to issue direction to opposite party/Appellate Authority to decide the appeal in a specific period. During course of submission the learned counsel for opposite parties has submitted a copy of the short reply wherein aforesaid order of the Appellate Authority is annexed as Annexure-R/1.

Counsel for the applicant submits that since the main grievance of the applicant for disposal of the pending appeal has already been decided by the Appellate Authority, hence the same be dismissed as having become infructuous.

In view of the above submissions, without entering into the merits of the case, the OA is dismissed as having become infructuous. The connected Misc. Application also stands disposed of.
