1. Present as under: Mr. Puneet Gogad along with Ms. Samita Vaviya i/b M/s. Pritesh Burad Associates, Counsel for Appellants. Mr. Rajesh Nagori, Counsel for Respondent No. 1. Ms. Radhika Chamaria, Counsel for Intervener.
2. The Counsel for the Appellant would submit that he has filed Application I.A. No. 436/2026 for impleading the Auction Purchaser in the array of the parties as Respondent Nos. 2 & 3. He would further submit that even the proposed Respondents have filed an application I.A. No. 514/2026 with similar relief.
3. The Learned Counsel for the Respondent No.1 has no objection for impleadment of the Auction Purchasers as Respondents.
4. Ms. Radhika Chamaria, Counsel for the proposed respondent, would submit that in her application I.A. No. 514/2026, further reliefs are also sought, but she does not press any other relief except relief at Para 32 (a) of the prayer.
5. Accordingly. I.A. Nos. 436/2026 & 514/2026 are allowed.
6. The Appellant is directed to file the amended memo of parties within two weeks.
7. List the case on 15.12.2026 for further proceedings.
8. Interim relief, if any, to continue till the next date of hearing.
