The file is taken on praecipe filed by Mr. Aviral Jain, Counsel for Applicant. The Learned Counsel for Applicant would submit that the Appeal was filed without the Waiver Application and the mandatory deposit as per section 18 of the SARFAESI Act as the Applicant has requested registry to place it on the board on the point that no mandatory pre-deposit needed. He would further submit that the registry has placed the case on 12.10.2026.
However, at this stage moved the application for the waiver on mandatory pre-deposit by way of praecipe.
