1. Present as under: Mr. Mangesh Patel, Counsel for Appellant. No representation for Respondents despite repeated calls.

2. The Counsel for the Appellant files Service Affidavit. Same is taken on record.

3. The Learned Counsel for the Appellant would submit that this Misc. Appeal No. 129/2026 was fixed on 07.09.2026 however, the Chairperson of the DRAT was not available, consequently, board was discharged. The Counsel for the Appellant would further submit that vide order dated 20.05.2026 the interim order was continued till the next date of hearing; that, however, on 07.09.2026 the interim order could not be continued as the Chairperson was not available and board had been discharged. The Counsel for the Appellant would further submit that taking

advantage of this peculiar situation, the Respondents have issued notice dated 28.09.2026 through Advocate Court Commissioner and to take police protection for taking the possession of the secured property on 23.10.2026 as reflected in Exhibit-E to the I.A. No. 618/2026.

4. Considered and perused the record.

Vide order dated 02.04.2026, this Appellate Tribunal had directed to defer the possession scheduled on 07.04.2026 till next date of hearing and the same was extended time to time on 22.04.2026 and vide order dated 20.05.2026 till 07.09.2026, however, on 07.09.2026 the Chairperson of the DRAT was not available therefore the board was discharged therefore the interim order dated 02.04.2026 shall continue in view of the above till the next date of hearing.

6. List the matter on the date already fixed i.e. 04.12.2026 for hearing.
