1. Present as under:

2. The Learned Counsel for Appellant seeks adjournment.

3. The Learned Counsel for Respondent No. 1/Finance Company objects the adjournment with the submission that vide order dated 09/09/2026 in Writ Petition No. 11604/2026 the Hon’ble High Court of Bombay has directed to decide this Appeal on or before 15.12.2026.

4. At the same time, the Counsel for the Respondent Bank/Finance Company tenders his apology to give copy of this order (without pursis) only today notwithstanding the fact that this direction was given by the Hon’ble High Court on 09/09/2026.

The Counsel for Respondent would further submit , on query , that Respondent No. 1/Finance Company had not given the copy of this order to the Appellant.

5. The conduct of Respondent No. 1/Finance Company in not bringing the aforesaid order to the notice of this Appellate Tribunal or the Appellant until today is highly unsatisfactory and cannot be appreciated. Despite the specific direction of the Hon’ble High Court to decide the Appeal on or before 15.12.2026, the said order was not brought to the notice of this Tribunal for nearly two months, thereby resulting in the loss of valuable time available for compliance with the directions of the Hon’ble High Court.

6. The Learned Counsel for both parties are directed to exchange brief notes of their respective submissions and the citations they intend to rely upon during arguments before the next date of hearing.
