IN THE DEBTS RECOVERY APPELLATE TRIBUNAL AT KOLKATA

HON’BLE MR. JUSTICE ANIL KUMAR SRIVASTAVA CHAIRPERSON Misc. Appeal Diary No. 1387 of 2025 Order No. 11 31.07.2026 State Bank of India … Appellants -Vs- M/s. Himalaya Cold Storage & Another … Respondents Ms. Poetry Dutta, Learned Counsel for Appellant Mr. Debashis Karmakar with Mr. Arya Nandi and Mr. Satyam Ojha, Learned Counsel for Respondents THE APPELLATE TRIBUNAL: Heard the Learned Counsel for the parties and perused the record. Instant application filed under Section 17 (6) read with Rule 18 of the Securitisation of Financial Assets & Enforcement of Security Interest Act, 2002 for a direction to DRT-II, Kolkata for expeditious hearing of the pending I.A. 1487 of 2025 arising out of S.A. 85 of 2020. Matter is pending before the Learned DRT-II, Kolkata. We take judicial notice of the fact that no Presiding Officer is posted at DRT-III, Kolkata since January, 2026. Presiding Officer, DRT-II, Kolkata is holding additional charge of both the DRTs so the DRTs are heavily loaded. Every day Learned Presiding Officer, DRT-II, Kolkata is taking up good number of ‘Put up’ matters of both the DRTs. In such circumstances,

2 we do not find any reason to further burden DRT-II with an order for expeditious hearing. Accordingly, in the facts and circumstances of the matter, the Misc. Application stands disposed of. Mr. Debashis Karmakar has put in appearance on instruction.

(Anil Kumar Srivastava,J) Chairperson Dated: 31st July, 2026 11/ac
