1. M/s. SWAIN TRADERS, Office at Plot No. 108, Bidhyadharpur, Mahima Nagar, near Grama Padia, PO Nuabazar, PS Chauliaganj, Dist. Cuttack, PIN 753004.
2. Babuni Swain, residing at Plot No. 108, Bidhyadharpur, Mahima Nagar, near Grama Padia, PO Nuabazar, PS Chauliaganj, Dist. Cuttack, PIN 753004. ... Respondents For Appellant : Mr. Debasish Chakraborty , ld. adv. virtually For Respondent : THE APPELLATE TRIBUNAL : Heard learned counsel for the appellant and perused the records. Since relief sought for in this appeal is for expeditious hearing of the matter before the learned DRT, no notice is required to be issued to the opposite party. Appeal is being disposed of at the admission stage.
2. Instant appeal is filed u/s 17(6) of the SARFAESI Act, 2002 for a direction to the Learned DRT for expeditious hearing before the learned DRT. Learned counsel for the appellant would submit that direction was issued by this Tribunal in Misc. Appeal Dy. No.
870 of 2025 on 08.09.2025 to comply the order and amount has been deposited by the borrower. However, effective hearing could not be made by the learned DRT. Hence, direction may be issued for expeditious hearing.
3. Perusal of record would show that on different dates bank itself sought for adjournment of the matter. However, bank submits that that now objection was filed, but in view of the interim order passed in favour of the borrower, bank could not initiate proceeding for auction of the secured asset.
4. It appears that bank themselves sought time for filing objection, which was filed as per their own convenience. Now bank is seeking expeditious hearing of the matter since there is an injunction order in favour of the borrower.
5. Misc. application is disposed of with the observation that learned DRT should take hearing of the matter expeditiously as per its own roster. No unnecessary adjournment should be granted by the learned DRT to either of the parties. File be consigned to record room. Copy of the Order be uploaded in the Tribunal’s website. Order dictated, signed and pronounced by me in the open Court on this the 3rd day of August, 2026. (Anil Kumar Srivastava, J) Chairperson Dated : 03.08.2026 /pkb
