JUDGMENT

: 15th September, 2026 THE APPELLATE TRIBUNAL:

1. Heard the Learned Counsel for the parties and perused the records.

2. Instant application is moved under Section 17(6) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI ACT) (hereinafter referred as to as the ‘Act’), for expeditious hearing of the pending S.A. 422 of 2022, I.A. 7653 of 2026

pending before Learned DRT-II, Kolkata. Learned Counsel for the Appellant would submit that the S.A. is pending since 2022. Some I.A. were also filed which are pending but could not be taken up. It is further submitted that pending S.A. opposite parties have alienated the secured assets, hence there is an urgency in the matter for early hearing.

3. Learned DRT-II Kolkata is holding the additional charge of Learned DRT-III Kolkata since January, 2026. We can take judicial notice of the fact that every day a large number of put-up applications is filed before Learned DRT-II Kolkata, which are being taken up by the Learned Presiding Officer. Since, appellant is having some urgency in the matter as the secured assets have been allegedly alienated by the Respondents, it needs an opportunity of hearing to the application. It is submitted that the matter is listed before Learned DRT-II Kolkata on 19.11.2026. It is expected that the Learned DRT-II Kolkata may take up the matter on the date fixed.

4. In such circumstances, it is expected by the Learned DRT-II Kolkata to take up the S.A. 422 of 2022 along with I.As for hearing as expeditiously as possible as per its own roster. With the observations made above, application is disposed of.

O R D E R

Application is disposed of. Learned DRT-II Kolkata is directed to hear and decide the S.A. 422 of 2022 expeditiously as per its own roaster. File be consigned to Record room.

Copy of the Judgment/Final Order be uploaded in the Tribunal’s Website. Order signed, dated and pronounced in open Court.
