CENTRAL ADMINISTRATIVE TRIBUNAL PATNA Order Sheet Item no.: 37 M.A./589/2026 (PATNA) [ EARLY HEARING ] [ SENIOR CITIZEN ] In O.A./738/2022 GRATUITY M.A./742/2022 AMENDMENT Court No.: 1 No of Adjournment: Order Dated: 16/10/2026 MURLI DHAR TIWARI Vs EASTERN RAILWAY

For Applicant(s) Advocate : Mr. Sudhanshu Kumar For Respondent(s) Advocate : Mrs. P. R. Lakshmi, ASC, V/c mode Order of The Tribunal

Heard Learned Counsel for the parties. Counsel for the applicant submits that the instant MA No. 589/2026 has been filed seeking to expedite the date of hearing in OA, which is presently fixed on 04.12.2026. Counsel for the applicant submits that the applicant is ill, that is why he wants early hearing of the OA. However, upon perusal of the MA and the documents annexed thereto, we find that the medical prescription relied upon by the applicant pertains to the year 2024 and, therefore, does not establish the applicant’s present medical condition. The Original Application pertains to the year 2022. Since a large number of older cases, pertaining to the years prior to 2022, are pending for hearing and there is a direction of CAT, Principal Bench for early hearing of critical old cases, it is not feasible to expedite the date of hearing in the present case. List the case on the date already fixed, i.e., 04.12.2026. However, on the date fixed for hearing, Counsel for the applicant may have liberty to mention the case, if so required. Accordingly, MA No.589/2026 stands disposed of.
