For Respondent(s) Advocate : Shri M.D.Dwivedi, ASC. Order of The Tribunal Shri Rajendra Prasad, ld. counsel for applicant and Shri M.D.Dwivedi, ld. ASC for opposite parties are present. Written statement has been filed by opposite parties no. 1 to 4 and rejoinder to that has also been filed by the applicant. So far opposite party no.5 is concerned, it transpires from the record that notice was issued to him on 10.09.2026 and as per office report same was delivered also, but still none is present today on his behalf, neither any representation has been moved on his behalf. It appears that the opposite party no.5 is not interested to file the written statement. In view of above, there is no option before us but to proceed further with the case. Accordingly, the case is proceeded exparte against him. Heard.
