Looking at the record I find that the learned counsel for the applicant has not been appearing since 29.11.2025., i.e. approximately one year. Further, it has also been found that the applicant despite being granted an opportunity did not file the rejoinder. Therefore, pleading was treated as complete presuming that the applciant is not interested in filing the rejoinder and matter was fixed for final hearing. As already observed, in view of the fact that learned counsel for the applicant has not been appearing since about an year, let notice be issued to the applicant to appear either in person or through effective legal representative failing which the matter will be decided as per Rule 15 of CAT(Procedure) Rules, 1987. Registry is directed to issue notice to the applicant. List this case on 19.11.2026.
