CENTRAL ADMINISTRATIVE TRIBUNAL PATNA Order Sheet Item no.: 1 O.A./406/2026 (PATNA) [ PROMOTION ] [ SENIOR CITIZEN ] Court No.: 1 No of Adjournment: 6 Order Dated: 13/10/2026 SHAILENDRA PRASAD SINHA Vs HOME AFFAIRS

For Applicant(s) Advocate : Shri Mayank Rukhaiyar (through VC)

For Respondent(s) Advocate : Shri T.N.Thakur, Sr. CGSC. Order of The Tribunal MA No. 501 of 2026 Shri Mayank Rukhaiyar, ld. counsel (appearing through VC) for applicant and Sri T.N.Thakur, ld. Sr. CGSC for opposite parties are present. Counsel for the applicant has submitted that the claim of the applicant is related with non-payment of the MACP amount for which he is entitled and he is suffering financial loss every month. Therefore, the cause of action be treated as continuous. Counsel for the applicant based his argument on the basis of judgment of the Hon'ble Apex Court in the case of M.R.Gupta vs. Union of India (1995) 5 SCC 628. On the other hand, counsel for the opposite parties has not filed any reply despite providing opportunity vide order dated 11.09.2026 and he requested to adjourn the case, but he could not give the reason as to why reply to Misc. Application has not been filed even after lapse of one month's time. Heard and perused the record. The grounds mentioned in the application, in our view, are sufficient. The application is supported with affidavit which is uncontroverted. Hence, the Misc. Application No. 501 of 2026, which has been filed by the applicant for condonation of delay in filing the instant OA, is hereby allowed and the delay in filing the instant OA is condoned. With this, the MA No. 501 of 2026 stands disposed of. OA No. 406 of 2026 So far as the case of the applicant is concerned, learned counsel for the applicant has submitted his case. The matter requires consideration. Since Shri T.N.Thakur, ld. counsel for opposite parties has appeared and accepted notice on behalf of the opposite parties, as such issuance of formal notice stands waived off. Respondents shall file their reply/written starement within four weeks from today. List the case on 25.11.2026.
