CENTRAL ADMINISTRATIVE TRIBUNAL PATNA Order Sheet Item no.: 4 O.A./696/2026 (PATNA) [ PENSIONARY BENEFITS ] [ SENIOR CITIZEN ] Court No.: 1 No of Adjournment: Order Dated: 13/10/2026 LALTI Vs DEPARTMENT OF POSTS

For Applicant(s) Advocate : Shri J.K.Karn.

For Respondent(s) Advocate : Shri T.N.Thakur, Sr. CGSC. Order of The Tribunal Shri J.K.Karn, ld. counsel for the applicant and Shri T.N.Thakur, ld. Sr. CGSC for opposite parties are present. Counsel for the applicant submitted his case. His submission is that the present matter is covered by the judgment of Union of India vs. Bhikhani Devi (CWJC No. 15420 of 2019) decided by the Hon'ble High Court of Patna and same has been upheld by the Hon'ble Apex Court. He further submitted that after pronouncement of judgment, the department is intending to consider the claim of applicant but still the matter has not been finalised. The matter requires consideration; hence, notice needs to be issued to the opposite parties. Since Shri T.N.Thakur, Sr. CGSC, on receipt of an advance copy of the OA has appeared on behalf of the opposite parties and accepted notice, hence issuance of notice stands waived off.

Counsel for the opposite parties submitted that he may be given an opportunity to seek instructions in the matter from the department. In view of the above submissions, we direct the counsel for the opposite parties to seek and submit instructions in the matter in two weeks from today. List the case on 09.11.2026.
