CENTRAL ADMINISTRATIVE TRIBUNAL PATNA Order Sheet Item no.: 17 O.A./340/2026 (PATNA) [ DISMISSAL FROM SERVICE ] Court No.: 1 No of Adjournment: 4 Order Dated: 13/10/2026 RITA DEVI Vs EAST CENTRAL RAILWAY

For Applicant(s) Advocate : Mr. S. S. P. Yadav For Respondent(s) Advocate : Mr. T. N. Thakur, Sr. CGSC Order of The Tribunal MA No. 284/2026 Heard the contentions of Learned Counsel for the parties. The Opposite Parties have filed their reply to the instant MA. Upon consideration of the grounds set forth in paragraphs 6 to 9 of the MA, we find that the applicant has sufficiently explained the delay of four years, one month and twenty-two days in filing the instant OA. The applicant has also pleaded her entitlement to family pension following the demise of her husband. In view of the facts and circumstances of the case, we are satisfied that sufficient grounds have been made out for condonation of the delay , hence the delay in filing the OA is condoned. Accordingly, MA No. 284/2026 is allowed, and the objections raised thereto stand disposed of. OA No. 340/2026 Vide order dated 24.08.2026, the applicant was directed to explain why her deceased husband had not preferred an appeal against the order of removal dated 24.11.2021. In compliance therewith, Counsel for the applicant has filed a supplementary affidavit. The contents of the supplementary affidavit shall be considered on merit at the time of final hearing. Since the pleadings are complete, the OA is admitted. List the matter for final hearing on 30.11.2026. In the meantime, Counsel for the Opposite Parties shall obtain instructions and apprise this Tribunal as to whether the appeal against the order of removal is still pending or has been decided.
