Both parties are represented by their respective learned counsel.

Heard both sides.

It has been submitted by the learned counsel for the appellant bank that the sale has already been confirmed. It is seen that the matter has now become infructuous and it is also seen that the S.A is still pending in DRT-1, Kolkata. Therefore It would be appropriate if the following order is passed:- ‘The appeal is dismissed as infructuous. The Learned Presiding Officer, DRT-1 is directed to take up the S.A and dispose of the same within a period of 120 working days from today’ (Dictated to the Stenographer, transcribed by him, corrected, signed and pronounced by me on thisthe 17th day of March, 2021).
