Both parties are represented by their respective learned counsel.

Learned counsel appearing on behalf of the appellant states that there were some difficulties in paying the amount for the earlier OTS and adds that he will submit a fresh OTS proposal before the Respondent/Bank for their kind consideration.

Learned counsel for the respondent Bank states the appellant may file a fresh OTS application before the Bank and the Bank will duly consider the same.

In view of the above submissions, the following order is passed.

“The appellant may file a fresh OTS application and the Bank is directed to consider the same in accordance with law. In the event of the respondent Bank taking any coercive action at any time the appellant will be at liberty to approach the proper forum for the redressal of the same.

This appeal is disposed of accordingly. (Dictated to the Stenographer, transcribed by him, corrected, signed and pronounced by me on thisthe 17thday of December, 2020).
