Pal Choudhuri, Ms. Saswati Sikder, Learned Counsel for the Respondents. THE APPELLATE TRIBUNAL : Heard the Learned Counsel for the parties. It is a very peculiar case. It appears that an ex parte was passed in O.A. 123 of 2007 on 28.09.2022, thereafter the impugned judgement was passed on 08.08.2025. None of the parties have produced any order as to whether the judgement and order dated 28.09.2022 was recalled or not. Respondent is hereby directed to place on record the order of recall of the order dated 28.09.2022 before the next date of listing. List on 18th August, 2026 for hearing.
