IN THE DEBTS RECOVERY APPELLATE TRIBUNAL AT KOLKATA I.A. No. 481 of 2026 In Misc. Application Dy. No. 321 of 2026 THE HON’BLE JUSTICE SHRI ANIL KUMAR SRIVASTAVA, CHAIRPERSON Order No. 34 31.07.2026

Donthu Ravi Prasad Gupta

... Appellant --Vs— Karnataka Bank Ltd. .... Respondents For Appellant : In person

For Respondent : Mr. Anirban Pramanik, ld.. adv. Ms. Subhasri Day, ld. Adv.

THE APPELLATE TRIBUNAL

I.A. 481 of 2026 is filed by the review petitioner for restraining the bank from conducting the e-auction sale on 01.08.2026 in pursuance of the sale notice dated 06.07.2026. Opposition filed by the bank. Heard the appellant in person and learned counsel for the bank. Appeal No. 53 of 2021 was filed against the order dated 12.11.2021 passed by learned DRT-II Hyderabad in S.A. 188 of 2021 (Ravi Prasad Gupta D Vs. Karnataka Bank & Anr.). Appeal was allowed on 24.02.2026 after hearing learned counsel for the appellant. Despite granting sufficient opportunity none appeared for the respondent, although respondent has put in appearance in person earlier. Appeal was partly allowed. Judgment and order dated 12.11.2021 passed by learned DRT-II Hyderabad in SA 188 of 2021 was modified to the extent that the S.A. was allowed quashing e-auction sale notice dated 15.09.2021. Further bank was given opportunity to recover its dues in accordance with law with further direction to refund the bid amount to the bidder with interest at the rate of 9% per annum. Thereafter, a review petition was filed by the respondent in appeal in Misc. Application Dy. No. 321 of 2026. Review was sought for on different grounds.

Pending appeal, I.A. 253 of 2026 was filed seeking stay of conducting e-auction proceeding scheduled on 08.05.2026 which was disposed of on the same day i.e. 08.05.2026 wherein bank was restrained from conducting e-auction sale on 08.05.2026 till the next date of listing. After passing of the order, learned counsel for the bank submitted that sale was fixed on that date, but there was no bid received by the bank. Thereafter, matter was listed for hearing on 14.07.2026. In the meantime, again bank issued sale notice dated 06.07.2026 fixing e-auction on 01.08.2026. Instant I.A. is filed for staying the e-auction sale on different grounds. Earlier also auction sale fixed by the bank on 08.05.2026 was restrained, although sale could not be fructified for want of bidder. Again e-auction sale is conducting by the bank fixing date on 01.08.2026. In view of the above, I find it appropriate that e-auction sale fixed on 01.08.2026 should not be conducted till the next date of listing of review petition, which is listed on 02.09.2026. I.A. 253 of 2026 stands disposed of. (Anil Kumar Srivastava, J) Chairperson Dated : 31.07.2026 05/pkb
