I.A. 442 of 2026 is filed by the secured creditor under Order 41 Rule 27 CPC for placing on record the documents in the form of additional evidence relating to affixation of tender-cum-auction sale notice dated 15.09.2023. Heard learned senior counsel for bank, learned counsel for auction purchaser as well as learned counsel for borrower and perused the records. It is submitted that impugned order was passed by learned DRT-Visakhapatnam on 08.05.2024 considering the document which was not in the file of learned DRT. However, the same is brought on record. But finding is recorded by the learned DRT about violation of Rule 8(7) of the Security Interest (Enforcement) Rules, 2002 since legible copy of the same are not filed along with application. Having gone through the record, I find it appropriate that the document filed in the I.A. 442 of 2026 be taken on record for just and proper decision of the appeal. Accordingly, without recording any observation on merit of the matter, we allow the I.A. 442 of 2026 and the document as additional evidence is taken on record.
