IN THE DEBTS RECOVERY APPELLATE TRIBUNAL AT KOLKATA Appeal Dy. No. 323 of 2026 THE HON’BLE JUSTICE SHRI ANIL KUMAR SRIVASTAVA, CHAIRPERSON Order No. 07 04.08.2026

AO, Union Bank of India & Anr.

... Appellant --Vs— M/s. Sri Venkateswara Cotton Ginning Mill & Anr. .... Respondents For Appellant : Mr. Ranajit Chowdhury, ld. Adv. Mr. Sudipto Chowdhury, ld. Adv.

For Respondent : THE APPELLATE TRIBUNAL Matter is taken up in the revised list. None is present for the respondent despite effective service. I.A. 230 of 2026 is filed u/s 5 Limitation Act for condonation of 31 days’ delay in preferring the appeal. Appeal is filed against the impugned order dated 07.01.2026 passed by learned DRT – Visakhapatnam allowing the S.A. 185 of 2020. Application for obtaining certified copy was made on 09.01.2026 and it was notified on 20.01.2026. Appeal is filed on 21.03.2026. Learned counsel for appellant would submit that delay is not intentional rather delay caused for obtaining approval from the competent authority. Thereafter memo of appeal was prepared and it was filed. Having considered the submission made by the learned counsel for appellant, I found the ground to be sufficient for condonation of delay. Accordingly, I.A. 230 of 2026 is allowed. Delay in preferring the appeal is condoned. Admit the appeal by providing regular appeal number. Opposition to the appeal be filed within three weeks with copy to the appellant who may file rejoinder within a week thereafter. List on 28.09.2026 for hearing of appeal. (Anil Kumar Srivastava, J) Chairperson Dated : 04.08.2026 07/pkb
