O R D E R
Appeal is allowed. Matter is remanded back to the Learned DRT to decide it afresh, in the light of observations in the judgement after giving an opportunity of hearing to the parties in accordance with law. Since this is an old matter of 2009, it is expected that the Learned DRT should decide the matter as expeditiously as possible, preferably within a period of 12 weeks from the date of copy of this judgement is placed before the Learned DRT. File be consigned to Record room. Copy of the Judgment/Final Order be uploaded in the Tribunal’s Website. Order signed, dated and pronounced in open Court.
