**IN THE DEBTS RECOVERY APPELLATE TRIBUNAL AT KOLKATA HON'BLE MR. JUSTICE ANIL KUMAR SRIVASTAVA CHAIRPERSON**

**CAMP COURT AT DRT, CUTTACK Misc. Appeal No. 28 of 2025 (Arising out of SA No.12/2025)**

Order No.16 10.08.2026

Union Bank of India ....Appellant

-Vs- Pradeep Kumar Jena. ... Respondents

Mr. Tuna Sahu, Learned Counsel for the Appellant

Mr. Debasish Chakravorty, Learned Counsel for the Respondent (Through virtual mode)

**THE APPELLATE TRIBUNAL :**

Heard learned Counsel for the Appellant as well as Respondent and perused the record.

The instant appeal is preferred against the order dated 25/02/2025 passed by the learned DRT, Cuttack. The appeal was admitted on 02/04/2025 and the operation of the impugned order was stayed. Learned Counsel for the appellant submitted that sale certificate has already been issued in favour of the auction purchaser. Vide order dated 09/02/2026 specific direction was issued to the appellant bank to implead the auction purchaser but the auction purchaser is not impleaded as Respondent. However, learned Counsel for the appellant was allowed to implead the auction purchaser subject to Rs.10,000/- as cost. The aforesaid order was challenged in WP (C) No.7538/2026

wherein the Hon'ble High Court of Orissa at Cuttack passed the order to the effect that "pendentelite impugned order levying Rs.10,000/- of cost is kept in suspended animation."

On this learned Counsel for the appellant on being asked on what ground writ petition is filed and what relief is sought for, learned Counsel for the appellant could not bring on record the relief sought for in the writ petition. However, order of the Hon'ble High Court reflects that the order passed for imposition of cost was kept in suspended animation. In such circumstances, despite specific order the auction purchaser is not impleaded in this appeal.

Keeping in view of the peculiar facts and circumstances of the case, let the matter be listed on 13/08/2026. On the date copy of the writ petition be filed so as to ensure what relief is sought for before the Hon'ble High Court.

List on 13/08/2026 for hearing.
