Appellant -Vs- Asomi & 6 Ors … Respondents Ms. Usha Doshi, Learned Counsel for Appellants THE APPELLATE TRIBUNAL: I.A. 530 of 2025 Application for amendment of application under Section 5 of the Limitation Act. Heard the Learned Counsel for Appellant and perused the record. During the course of hearing Learned Counsel for Appellant would submit that as per the proposed amendments are concerned, in paragraph 18 paragraph (2) and (3) are sought to be deleted. Further it is submitted that all the proposed amendment relates to the explanation for condonation of delay. Application, under Section 5 of the Limitation Act, is still pending disposal wherein even after due service Respondents have not put in appearance. Having heard the Learned Counsel, I find the ground to be sufficient. Accordingly, I.A. 530 of 2025 is allowed. Necessary amendment be carried out within three days. List on 13th October, 2026 for hearing of I.A. 56 of 2025.
