**THE APPELLATE TRIBUNAL:**

Heard the IA. No. 754 of 2025.

Application by the appellant for reducing the amount of pre-deposit in the appeal filed against the Judgment and Order dated 13th October, 2025 in OA. No. 517 of 2022 ***State Bank of India Vs. Smti Chetna Thakur & another*** by Learned DRT Guwahati, wherein Learned DRT allowed the OA and issued the recovery certificate for an amount of Rs.77,55,322.62 p along with interest at the rate of 10.55% per annum with monthly rest pendent elite and future. Feeling aggrieved by the impugned judgment, appellant preferred the appeal whereas a request is made for reducing the amount of pre-deposited as required under Section 21 of Act to an extent of 25%.

Heard the learned counsel for the parties and perused the record.

Instant appeal is preferred against under Section 20 of RDDBFI Act, wherein, a request is made for reducing the amount of pre- deposit under Section 21 of the Act, to 25% on the ground that the wife of the appellant is suffering from the neck tumour disease. It is further submitted that the appellant could not be able to deposit 50% of the debt rather he may be permitted to deposit 25% of the debt due. Learned counsel for the bank submits that the amount as on the date of filing of the appeal is Rs.79,61,949/- which include the interest awarded by the Learned DRT.

Having considered the submissions by the learned counsel for the parties and the ground taken by the appellant that his wife is suffering from serious ailment we found it appropriate that the appellant should be permitted to make a pre-deposit of 35% of the amount due on the date of filing of the appeal i.e. Rs. 79,61,949/- the same be deposited within 4(four) weeks. I.A. No. 754 of 2025 stands disposed of.
