IN THE DEBTS RECOVERY APPELLATE TRIBUNAL AT KOLKATA

HON’BLE MR. JUSTICE ANIL KUMAR SRIVASTAVA CHAIRPERSON Appeal No. 18 of 2026 Order No. 15 12.08.2026 K. Ram Prasad … Appellant -Vs- Bank of Baroda & 4 0thers

… Respondents Mr. Nemani Srinivas, Learned Counsel for the Appellant Mr. M. Manohar (Virtual), Learned Counsel for Respondent No. 1 Mr. Durga Prasad (Virtual), Learned Counsel for Respondent No. 2 THE APPELLATE TRIBUNAL: It appears that Respondent No. 1 Bank is trying to prolong the proceedings. On 3rd July, 2026 time was sought for and allowed to file opposition by Respondents No. 1 and

2. Vakalatnama on behalf of Respondent No. 4 is only on record. No other Vakalatnama is on record. Today again a prayer is being made by the Bank Counsel for time to file opposition but no Vakalatnama on behalf of Bank is on record, hence the request made by some Counsel could not be considered.

2 Accordingly, since despite granting sufficient time Bank has not filed opposition, right to file opposition stands forfeited. No opposition is filed by any other Respondents. List on 1st September, 2026 for hearing. Let a copy of this order be forwarded to the General Manager of the Bank of Baroda for information and necessary action.
