Received an appeal filed online on 13/10/2026 and hard copy on 16/10/2026 under section 18 of the SARFAESI Act, 2002 presented by Ld. Advocate Mr. Subhajit Chowdhury on behalf of Bank of Baroda & Anr., Appellant. The appeal has been filed on behalf of Bank of Baroda & Anr. against order dated 16/09/2026 passed by DRT-Visakhapatnam in IA/2999/2025 in SA/320/2025. Appeal fee of Rs.255/- vide Transaction Ref. ID 1310260070536 dated 13/10/2026 has been paid. The Vakalatnama has been filed by the Ld. Advocate. The case is under the jurisdiction of this Appellate Tribunal. Application is within the period of limitation. Stay application being I.A. No. 687 of 2026 is filed through online on 13/10/2026 and hard copy on 16/10/2026 with application fee of Rs.200/- vide Transaction Ref. ID 1310260070915 dated 13/10/2026. It is stated in para 9 at page 21 of memorandum of appeal that Since the issue involved is purely on the point of law whether the learned Tribunal was within its jurisdiction to allow the prayer of the Respondent/Borrower without even considering the merit of the challenge to the proceedings of the Bank, as such the requirement under law, if at all any, for the Appellant to make any deposit under the Act of 2002, may kindly be waived. Ld. Advocate for Appellant stated vide a letter dated 15.10.2026 that he has filed all annexures included in the paper books (volume-I, II and III) of the whole proceeding being SA/320/2025 which is filed in the DRT- Visakhapatnam. The matter may be placed before Registry bench on 19/11/2026 for filling affidavit of service.
