**THE APPELLATE TRIBUNAL:**
For Admission
Heard the Learned Counsel for the Applicant. Keeping in view the facts and circumstances of the case, let successful Auction Purchaser by impleaded as opposite party. Thereafter, notices be issued upon the opposite parties. Affidavit-of-service be filed within two weeks.
Opposition, if any, be filed within a week thereafter.
List on 12<sup>th</sup> November, 2026 for hearing.
Learned Counsel for the Applicant submits that the Recovery Officer is proceeding with the matter despite the fact that all the original documents, in possession of the Applicant Bank, have already been handed over in the Recovery Proceedings. Even the Secured Creditor is pressing for withdrawal of the Recovery Proceedings but they are not being permitted to do the same.
In such circumstances, Recovery Proceedings, pending before the Recovery Officer shall remain stayed till the next date of listing.
