Heard the Learned Counsel for the parties and perused the record. Instant appeal is preferred against order dated 09.12.2024 in pending O.A. 362 of 2022. Since debt has yet not been determined, there is no requirement for making pre deposit. I.A. 336 of 2025 stands disposed of. I.A. 335 of 2025 Application, under Section 5 of the Limitation Act, for condonation of delay in filing the appeal. Learned Counsel
2 for Appellant does not want to press the same with liberty to file afresh. I.A. 335 of 2025 accordingly stands dismissed with liberty as prayed for.
