Instant appeal is filed against the order dated 20.05.2026 passed by the learned DRT Visakhapatnam whereby learned DRT allowed the S.A. setting aside the auction sale. Since the appeal is filed by the auction purchaser there is no requirement of making pre- deposit as required u/s 18 of the SARFAESI Act, 2002. I.A. 439 of 2026 stands disposed of. Admit the appeal by providing regular appeal number. Opposition be filed within four weeks with copy to the appellant who may file rejoinder within two weeks thereafter. List on 10.12.2026 for hearing along with Appeal Dy. No. 795 of 2026. Respondent no.1 and 2 prays for an order of status quo on the ground that appellant is trying to change the nature of the property. It is submitted that appellant is in possession of the secured asset. There are issues to be considered in the appeal. Accordingly, parties are directed to maintain status quo till the next date of listing. Operation of the impugned order shall also remain stayed.
