**THE APPELLATE TRIBUNAL:**

**I.A.366/2026**

I.A.366/26 is an application filed by the Appellant for condoning the delay of 17 days in filing the appeal against the judgement and order dt.23.01.2026 passed by the Ld.DRT-II, Hyderabad in Recovery Appeal No.01/2022 arising out of R.P.No.728/2018 in O.A.123/1997.

Heard Ld.counsel for the parties and perused the record. Ld. Counsel for the Appellant would submit that the delay is not intentional rather due to the ailment of the wife of the Petitioner who undergone a medical surgery. No opposition from the Ld.counsel for the Respondent Bank.

Having heard the submissions of both the Ld.counsel, I find there is sufficient ground to condone the delay.

Accordingly, I.A.366/26 is allowed by condoning the delay of 17 days in filing the appeal.

Admit the appeal by providing regular appeal number.

Opposition to the appeal be filed within three weeks with a copy to the Ld.counsel for the Appellant and rejoinder be filed within two weeks thereafter.

List the matter on 20.11.2026 for hearing.
