Manoj Kr. Jaiswal & Ors.

... Appellant --Vs— AO, Punjab National Bank & Anr. .... Respondents For Appellant : Mr. Nemani Srinivas, ld. Adv. Mr. Krishanu Mondal, ld. Adv.

For Respondent : Ms. Anindita Das, ld. Adv. Ms. Mayuree Chakraborty, ld. Adv.

THE APPELLATE TRIBUNAL I.A. 511 of 2026 is filed u/s 5 Limitation Act for condonation of 14 days delay in preferring the appeal. Appeal is filed on 25.07.2026 against the order dated 22.05.2026. Learned counsel for the appellant submits that delay is not intentional rather due to obtaining necessary approval from the competent authority. Heard learned counsel for the parties and perused the records. Learned counsel for the respondent opposed the prayer. Having considered the submissions made by the parties, I found the ground to be sufficient for condoning the delay. I.A. 511 of 2026 is allowed. Delay in preferring the appeal is condoned. I.A. 510 of 2026 is filed for waiver from making pre-deposit. Appellant is a borrower. Learned counsel for respondent bank submits that debt due on the date of filing appeal is Rs.89,47,032/-. Hence, appellant is required to pay 50% of the debt due as pre-deposit. At this stage learned counsel submits that appellant is facing financial crunch. Having considered the submission I found the ground to be sufficient to reduce the pre- deposit amount to 30% of the debt due. Appellant is directed to make payment 30% of Rs.89,47,032/- as pre-deposit within four weeks. I.A. 510 of 2026 is disposed of. List on 13.10.2026 for further order.
