O R D E R

(Per:- Sanjeev Gupta, Judicial Member)

Mr. Abhinav Sharma, learned Sr. Counsel representing the applicant submitted that the applicant is aggrieved of impugned transfer order dated 29.09.2026, whereby, illegally and arbitrarily, he has been transferred from office of Senior Architect Central to Senior Architect, Kashmir.

2. Learned Sr. Counsel further submitted that the impugned transfer order is the result of sheer malafide and colourable exercise of power by Respondent No. 2, as Respondent No. 2 had developed personal grudges against the applicant, after he approached this Tribunal earlier by filing O.A. No. 1355 of 2026 with regard to a seniority issue.

3. Learned Sr. Counsel further submitted that the Senior Architect Jammu Province has written a communication dated 29.09.2026 to Respondent No. 2 requesting therein to reconsider the transfer of the applicant as he was engaged in very important projects in Jammu Division.

4. Learned Sr. counsel further submitted that the applicant, for redressal of his grievance, had furnished a representation dated 30.09.2026 to Respondent No. 1, however, no decision has been taken on the same uptil now.

5. Learned Sr. Counsel also submitted that the applicant will be satisfied, at this stage, if this O.A. is disposed of with direction to respondents to treat a copy of this O.A. as representation of the ARUN KUMAR

applicant, decide the same within a time frame and till such time, the applicant may be protected.

6. Mr. Hunar Gupta, learned D.A.G. appearing for respondents, on advance notice, prayed for sometime to file reply.

7. Having heard the learned counsel for the parties, we are of the considered view that no useful purpose would be served in keeping this O.A. pending and same can be disposed of with directions to respondents.

8. Accordingly, this O.A. is disposed of, at the admission stage itself, without entering into the merits of the case, with direction to respondent No. 1 to treat a copy of this O.A. as representation of the applicant and decide the same by passing a reasoned and speaking order within a period of three weeks from the date of receipt of a certified copy of this order. A copy of the speaking order be also communicated to the applicant.

9. Till then, the respondents are restrained from taking any coercive measures against the applicant to make him join at his new place of posting in terms of impugned transfer order dated 29.09.2026.

10. There shall be no orders so as to costs.
