1. The applicants have filed the present Original Application under Section 19 of the Administrative Tribunals Act, 1985 seeking the following reliefs: -
1) OA/159/2023 I. Allow this Original application of the applicants. II. Call for the records from the respondents. III. Quash order no. CEJ/KDM/Court/19 of 2021 dated 12-01-2021 as well as order No. CEJ/Adm/Court/DPC/43 of 2022 dated 04- 05-2022 issued by the respondent no. 6 whereby the case of the applicants for the purpose of allowing the benefit of higher pay scale of Rs. 220-430 (pre-revised) at par with the similarly situated persons more particularly the Performa respondents 15 to 242 herein have been rejected without any cogent reason, thus depriving the applicants of their right to receive equal pay for equal work. Direct the respondents to forthwith remove the discrimination to the petitioners vis-avis other similarly situated class of persons including the performa respondents 15 to 242 herein in the matter of allowing the benefit of pay scale of Rs 220-430 (pre-revised) with all pay revisions from time to time and release of all consequential benefits from the date of initial appointment of the petitioners as line erector, SBA, electrician, technician III, telephone operators in the light of Judgment passed by this Hon'ble Court in LPA(ŞWP) 105/13 titled State of J&K Vs Sanjay Gupta & Ors and further upheld in SLP (C) no. 23075/14 and also in terms of schedule-I of SRO 381 of 1981 dated 26-08-1981 most specifically S.No. 10 Part A executive cadre. V. Direct the respondents to produce the whole record relating to each and every person/employee including the Performa respondent no. 15 to 242 herein having been allowed the benefit of pay scale of Rs. 220-430 (pre-revised) along with the eligibility chart indicating the eligibility of all such employees in terms of

the one class of person/employees, as such violation of article 14 & 16 of the constitution of India. IV. Command the respondents to forthwith remove the discrimination to the petitioners vis-a-vis other similarly situated class of persons including the performa respondents 21 to 250 herein in the matter of allowing the benefit of pay scale of Rs 220-430 (pre-revised) with all pay revisions from time to time and release of all consequential benefits from the date of initial appointment of the petitioners as line erector, SBA, electrician, technician III, telephone operators in the light of Judgment passed by this Hon'ble Court in LPA(SWP) 105/13 titled State of J&K Vs Sanjay Gupta & Ors and further upheld in SLP (C) no. 23075/14 and also in terms of schedule-I of SRO 381 of 1981 dated 26-08-1981 most specifically S.No. 10 Part A executive cadre. V. Command/Direct the respondents to produce the whole record relating to each and every person/employee including the Performa respondent no. 21 to 250 herein having been allowed the benefit of pay scale of Rs. 220- 430 (pre-revised) along with

the eligibility chart indicating the eligibility of all such employees in terms of the provisions of the Recruitment Rules (Supra). VI. Pass such Order or Direction that this Hon'ble Tribunal deems just and proper to pass/issue in the interests of justice in the attendant facts and circumstances of the case.
2. The facts of the case as pleaded by the petitioners in their pleadings are as follows: - a) Since both these Original Applications involve a common question of law and substantially similar facts, particularly regarding the entitlement of the applicants to the pre-revised pay scale of Rs. 220–430 under the Jammu and Kashmir Power Development Department (Subordinate) Service Recruitment Rules, 1981, notified vide SRO 381 dated 26.08.1981, they are being taken up together for disposal by a common judgment. b) The applicants in both the Original Applications are employees of the Power Development Department, Jammu and Kashmir, who were appointed as Technician-III through the selection process conducted by the Jammu and Kashmir Services

Selection Board. After their appointments, they were adjusted against different technical posts, including Line Erector, Electrician, Switch Board Attendant, Telephone Operator and other allied posts in various divisions of the department. According to the applicants, they possess the requisite qualifications and have been performing the duties attached to these posts since their initial appointments. c) The applicants submit that their service conditions are governed by the Jammu and Kashmir Power Development Department (Subordinate) Service Recruitment Rules, 1981, notified vide SRO 381 dated 26.08.1981. They contend that Serial No. 10 of Part-A (Executive Cadre) of Schedule-I to these Rules provides the pre-revised pay scale of Rs. 220–430 for various technical posts, including the posts against which they have been working. Their grievance is that despite performing duties against these posts, they have not been granted the prescribed pay scale. d) The applicants further submit that several other employees of the same department, who were appointed through the same

selection process or subsequently appointed or promoted, have already been granted the benefit of the aforesaid pay scale. According to them, many such employees are junior to the applicants and are performing similar duties. However, the applicants have been denied the same benefit without any reasonable justification. e) It is stated that the dispute regarding the grant of the pre-revised pay scale of Rs. 220–430 had earlier been raised before the Hon’ble High Court of Jammu and Kashmir by similarly situated employees. In SWP No. 2245/2001, the Hon’ble High Court granted relief concerning the applicable pay scale. The said judgment was subsequently relied upon in several other writ petitions filed by employees of the department seeking similar benefits. f) Thereafter, a batch of writ petitions, including SWP No. 2229/2011 and connected matters, came to be decided by the Hon’ble High Court vide judgment dated 11.10.2012. The Hon’ble High Court observed that employees forming one class under the applicable service rules could not be placed in

different pay scales without a lawful basis. It was further observed that the department was under an obligation to implement its statutory service rules uniformly and could not deny the benefit to similarly situated employees merely because they had not approached the Court earlier. g) The applicants submit that the judgment dated 11.10.2012 was upheld by the Hon’ble Division Bench in the connected Letters Patent Appeals, including LPA(SW) No. 105/2013, titled State of J&K v. Sanjay Gupta and Others. The matter was thereafter carried before the Hon’ble Supreme Court through Special Leave Petitions, which were dismissed. Consequently, the benefit of the pre-revised pay scale of Rs. 220–430 was extended to several employees who were parties to the earlier litigation. h) It is further stated that the benefit was subsequently extended to other employees through various orders passed by the Hon’ble High Court and this Tribunal. The applicants have referred to a number of writ petitions and Original Applications in which similarly situated employees were granted relief or their cases

were directed to be examined in accordance with the applicable rules and earlier judgments. i) The applicants contend that the respondents have adopted different standards while extending the benefit of the higher pay scale. While several employees have been granted the benefit pursuant to judicial orders, the applicants have been denied the same, even though they claim to be similarly placed. They have relied upon the seniority list issued vide communication No. CEJ/DPC/Tech-III/1982-2014 dated 22.02.2021 to demonstrate that some of the employees receiving the higher pay scale are junior to them. j) The applicants have also referred to the orders passed by this Tribunal in several earlier Original Applications, including OA No. 158/2020, OA No. 273/2020, OA No. 280/2020, OA No. 281/2020, OA No. 282/2020 and other connected matters. According to them, the respondents granted the higher pay scale to several employees following these proceedings. Although the department subsequently attempted to withdraw the benefits granted to certain employees, the withdrawal orders were

challenged before this Tribunal and were set aside. The applicants submit that those employees have continued to receive the benefit. k) It is further submitted that the applicants had also approached this Tribunal seeking similar relief. In those proceedings, directions were issued to the competent authorities to examine their claims in the light of the applicable service rules and the judgments relied upon by them. However, instead of extending the benefit, the respondents rejected their claims through Order No. CEJ/KDM/Court/19 of 2021 dated 12.01.2021 and Order No. CEJ/Adm/Court/DPC/43 of 2022 dated 04.05.2022. l) The applicants contend that the rejection orders are based mainly on the grounds that they were directly recruited against posts carrying a lower pay scale, that the higher pay scale was attached to promotional posts and that they had approached the authorities after considerable delay. According to the applicants, these grounds are contrary to the statutory rules and the judgments already delivered in favour of similarly situated employees.

m) The applicants further submit that some of them had initiated contempt proceedings on account of non-implementation of the earlier directions of this Tribunal. During the pendency of those proceedings, the respondents issued the order dated 04.05.2022, again rejecting their claims. The applicants maintain that the order does not properly address the question of discrimination or the benefit already extended to their service colleagues. n) It is also stated that some of the applicants and similarly situated employees approached the Hon’ble Supreme Court seeking extension of the benefits granted to other employees. The Hon’ble Supreme Court disposed of the proceedings by granting liberty to avail the appropriate remedy. The applicants have accordingly pursued their grievances through the present proceedings. o) The applicants submit that they are not seeking any benefit outside the statutory service rules. Their claim is that the department must apply the same rules uniformly to all employees belonging to the same category. They contend that once the benefit of the pay scale of Rs. 220–430 has been

extended to similarly situated employees, the respondents cannot deny the same benefit to the applicants without establishing a lawful distinction between them. p) The applicants have also challenged the stand of the respondents that they accepted their initial appointments with knowledge of the prescribed pay scale. According to them, acceptance of employment cannot deprive an employee of a benefit otherwise available under the statutory rules, particularly when employees performing similar duties have already been granted that benefit. q) The applicants further contend that the denial of the higher pay scale has resulted in continuing financial disadvantage and discrimination. They submit that the action of the respondents is contrary to Articles 14 and 16 of the Constitution of India and the principle of equal treatment among similarly situated government employees. r) In these circumstances, the applicants in both Original Applications have sought quashing of the rejection orders dated 12.01.2021 and 04.05.2022 and a direction to the respondents to

grant them the pre-revised pay scale of Rs. 220–430, together with subsequent pay revisions and consequential service and monetary benefits from the dates of their initial appointments against the relevant technical posts. They have also sought examination of the benefits granted to other employees, including those junior to them, and such further relief as may be considered appropriate.

The respondents have filed their reply statement wherein they have averred as follows: - a) On merits, the respondents submit that the applicants were appointed as Technician-III through direct recruitment conducted by the Jammu and Kashmir Services Selection Board. Their appointments were made against posts carrying the pay scale prescribed at the relevant time, which they accepted without objection. The respondents contend that the applicants cannot claim a higher pay scale merely because certain other employees have received such benefits pursuant to judicial orders.

b) The respondents submit that the service conditions of the applicants are governed by the Jammu and Kashmir Power Development Department (Subordinate) Service Recruitment Rules, 1981, notified vide SRO 381 dated 26.08.1981. They acknowledge that Serial No. 10 of Schedule-I provides the pre- revised pay scale of Rs. 220–430 for certain technical posts, including Line Erector, Electrician, Meter Reader, Switch Board Attendant and other specified posts. However, according to the respondents, the applicants are not automatically entitled to the said pay scale merely because they have been adjusted against or have performed duties attached to such posts. c) The respondents further submit that Schedule-II of SRO 381 of 1981 prescribes the method of recruitment to the posts carrying the pre-revised pay scale of Rs. 220–430. According to them, these posts are promotional posts, for which the Rules provide promotion from the prescribed feeder categories in the specified proportions of 67% and 33%, subject to the required service and qualifications.

d) It is specifically pleaded that the applicants were directly recruited and have never been regularly promoted to the posts carrying the pre-revised pay scale of Rs. 220–430. The respondents contend that promotion to such posts can be granted only by the competent authority after examining eligibility, seniority, merit and suitability and upon the recommendations of the Departmental Promotion Committee. Since the applicants have not been promoted in accordance with the prescribed procedure, they cannot claim the pay scale attached to those promotional posts as a matter of right. e) With regard to the judgments relied upon by the applicants, the respondents submit that the Hon’ble High Court had granted relief to particular employees who had approached the Court through different writ petitions. The judgments were subsequently upheld in the connected Letters Patent Appeals and Special Leave Petitions. However, according to the respondents, the applicants in the present Original Applications were not parties to those proceedings and cannot automatically

claim the same relief without satisfying the conditions prescribed under the applicable service rules. f) The respondents have further stated that the matter relating to implementation of the judgments of the Hon’ble High Court was examined in consultation with the Finance Department. The Finance Department, vide U.O. No. A/234(2002)-I-793 dated 01.08.2018, conveyed its agreement to implement the judgment dated 11.10.2012 in favour of the concerned Meter Readers and petitioners, subject to prior approval of the competent authority. According to the respondents, the said concurrence was confined to implementation of the judgments in the specified cases and did not amount to a general decision granting the higher pay scale to every Technician-III. g) The respondents submit that this Tribunal had earlier disposed of several Original Applications filed by similarly situated employees with directions to examine their representations in accordance with the applicable service rules and judicial pronouncements. had also required the authorities to examine whether the claims had become stale on account of delay and laches. h) Pursuant to those directions, the matter was taken up with the Administrative Department. The respondents state that instructions were sought vide communication dated 25.08.2020. Thereafter, the Administrative Department, vide communication dated 02.12.2020, informed the concerned authorities that following the unbundling of the Power Development Department and delegation of powers to the distribution companies, the Managing Director and Chief Engineer were required to examine the cases and take appropriate action in accordance with law. i) The respondents further submit that instructions were also sought from the office of the Managing Director vide communication dated 09.12.2020. Subsequently, vide communication dated 29.12.2020, the Managing Director directed the concerned authorities to examine the claims in accordance with the applicable rules and instructions issued by the Administrative Department.

j) According to the respondents, the cases of the applicants were thereafter examined and rejected through the impugned orders dated 12.01.2021 and 04.05.2022. The respondents maintain that the rejection orders were passed after examining the relevant service rules, the nature of the applicants’ appointments, the judgments relied upon by them and the delay in raising their claims. They submit that the orders are lawful and do not call for interference by this Tribunal. k) The respondents have also raised the objection of delay and laches. It is submitted that the applicants were appointed around the year 1998 and continued to receive the pay scale attached to their appointments for a considerable period. According to the respondents, the applicants raised their claims for the higher pay scale after nearly two decades, mainly because certain other employees had succeeded in earlier litigation. l) The respondents contend that employees who remain silent for several years and subsequently approach the Court after other employees have obtained favourable judgments cannot necessarily claim the same relief. In support of this contention,

they have relied upon the judgment of the Hon’ble Supreme Court in State of Uttar Pradesh v. Arvind Kumar Srivastava, wherein the principle of equal treatment of similarly situated employees was explained along with the exceptions relating to delay, laches and acquiescence. m) The respondents have also referred to the judgments in Chairman, U.P. Jal Nigam v. Jaswant Singh and Government of West Bengal v. Tarun K. Roy to contend that stale service claims cannot be reopened after an unreasonable lapse of time merely because other employees have obtained relief through judicial proceedings. n) As regards the allegation that certain junior employees have been granted the higher pay scale, the respondents submit that benefits extended to employees who were parties to earlier judicial proceedings were granted in compliance with the orders of the competent Courts. They further contend that certain other employees, who were not parties to those proceedings, obtained the benefit of the higher pay scale without proper approval of the competent authority.

o) It is specifically pleaded that some employees obtained the benefit of the pay scale of Rs. 220–430 on the basis of a communication dated 05.06.2020, allegedly by misrepresenting the relevant facts and without obtaining the required approval. According to the respondents, any benefit granted erroneously to other employees cannot create an independent right in favour of the present applicants. p) The respondents further maintain that the applicants cannot claim the benefit of a promotional pay scale without fulfilling the conditions prescribed for promotion. Merely working against a particular post or performing similar duties does not, according to them, establish entitlement to the pay scale of that post when the statutory recruitment rules prescribe a separate procedure for appointment or promotion. q) The respondents have denied the allegation of discrimination and submit that the cases of the applicants and the employees who received relief pursuant to earlier judicial proceedings cannot be treated as identical merely on the basis of their designation or the nature of their duties. According to them, the

entitlement of each employee must be determined with reference to the applicable recruitment rules, the manner of appointment, eligibility for promotion and the relevant judicial orders. r) The respondents accordingly submit that the impugned orders dated 12.01.2021 and 04.05.2022 were issued after examining the claims of the applicants in accordance with the directions of this Tribunal. They maintain that the applicants have failed to establish any enforceable right to the pre-revised pay scale of Rs. 220–430 and that both Original Applications are liable to be dismissed.
4. Heard learned counsel for the parties and perused the material available on record.
5. The central question before this Tribunal is whether the applicants can be denied the pre-revised pay scale of Rs. 220–430 when the same benefit has already been granted to other employees of the Power Development Department who, according to the applicants, belong to the same cadre and are similarly situated.

6. There is no dispute that the service conditions of the concerned employees are governed by the statutory recruitment rules notified under SRO 381 dated 26.08.1981. It is also apparent from the pleadings that the dispute regarding the higher pay scale has been the subject matter of earlier litigation before the Hon’ble High Court of Jammu and Kashmir.
7. The applicants have placed considerable reliance upon the judgment dated 11.10.2012 and the subsequent proceedings in State of J&K v. Sanjay Gupta and Others. Their case is that the legal issue concerning the pay scale has already been decided and that the department has implemented the benefit in favour of several employees.
8. The respondents, on the other hand, have sought to distinguish the applicants on the ground that they were directly recruited as Technician-III and that the higher pay scale belongs to a promotional category under the recruitment rules.
9. This objection requires careful examination. A pay scale cannot be granted merely because an employee demands parity with another employee. Entitlement to a particular scale must ordinarily flow from

the applicable rules, a lawful appointment or promotion, or a binding judicial determination covering the employee's category.
10. At the same time, the department cannot apply the same recruitment rules differently to employees who are identically situated. If employees appointed in the same manner, holding the same posts and governed by the same service conditions have been granted a particular pay scale in implementation of a judicial decision, other employees belonging to that very class cannot be denied the benefit without a legally sustainable reason.
11. The principle of equality under Articles 14 and 16 of the Constitution requires the State to act fairly and consistently. Employees who are similarly placed must receive similar treatment unless there is a material difference between their cases.
12. We are conscious that equality cannot be claimed merely on the basis of an earlier irregular or illegal benefit. If a higher pay scale has been granted to another employee contrary to the statutory rules, that mistake cannot become the foundation for extending the same illegality to others.

13. However, the present controversy is not confined to a few isolated cases of alleged wrong pay fixation. The applicants have referred to earlier judicial decisions, departmental implementation orders and a substantial number of employees who have received the benefit. Their case is that the benefit was granted pursuant to the interpretation of the applicable service rules by the Hon’ble High Court.
14. The respondents have not disputed that the higher pay scale was extended to certain employees pursuant to judicial proceedings. Their principal objection is that those directions were confined to the persons who were parties to the earlier litigation.
15. In our view, the mere fact that an employee was not a party to an earlier judgment cannot, by itself, be a sufficient reason for denying a service benefit if the judgment has settled a legal issue applicable to an entire class of similarly situated employees. The real question is whether the employee seeking parity falls within that class.
16. In State of Uttar Pradesh and Others v. Arvind Kumar Srivastava and Others, (2015) 1 SCC 347, the Hon’ble Supreme Court explained that similarly situated employees should ordinarily receive similar treatment, but that delay, acquiescence and the nature of the earlier

judgment are relevant considerations. The decision does not create an unrestricted right to reopen every settled service matter.
17. Applying that principle, the respondents were required to examine whether the applicants were similarly situated to the employees who had obtained relief under the earlier High Court judgments. Such examination had to be based on their appointment orders, the applicable recruitment rules, the nature of the posts held by them and the reasons for granting the higher pay scale to the employees relied upon as comparators.
18. The applicants have specifically alleged that some of their juniors have been granted the benefit. This allegation is important because, if established in respect of employees belonging to the same category, it would call for a clear explanation from the department.
19. The respondents have relied upon the distinction between direct recruitment and promotion. That distinction may be legally relevant where the rules prescribe separate pay scales for different categories. But the respondents must establish that the distinction actually applies to the applicants and to the employees with whom they seek parity. It is not enough to refer generally to the recruitment rules without

examining the treatment of employees appointed under the same provisions.
20. We also find that the respondents’ reliance upon the Finance Department’s concurrence dated 01.08.2018 does not, by itself, answer the question of equality. An administrative concurrence may have been issued for implementing the judgment in favour of named employees. Nevertheless, where the underlying judicial decision lays down a principle applicable to other employees belonging to the same class, the department must apply that principle consistently, subject to the statutory rules.
21. The purpose of judicial proceedings is not merely to grant relief to the individuals who first approach the Court, but also to ensure that the law is applied fairly. Government employees should not ordinarily be compelled to institute separate proceedings for the same benefit when their legal position is identical and the issue has already been settled.
22. At the same time, this Tribunal must ensure that the benefit is not extended to a category which was never covered by the earlier judgments. The applicants’ entitlement must therefore be understood

in the light of the relevant provisions of SRO 381 of 1981 and the actual scope of the High Court decisions.
23. In the facts of the present cases, the applicants have raised a substantial claim of discrimination supported by reference to earlier judgments and benefits granted to other employees. The rejection of their claims solely on the grounds that they were not parties to the earlier proceedings or that the Finance Department’s concurrence named particular employees would not be sufficient if their service position is otherwise identical.
24. We now turn to the objection regarding delay and laches. The respondents have argued that the applicants approached the Tribunal after a considerable lapse of time and should therefore be denied relief. It is true that service disputes should ordinarily be raised within a reasonable period. Courts must also protect settled administrative arrangements from being reopened after an unreasonable delay.
25. However, the nature of the grievance is relevant. Where an employee continues to receive pay fixed at an allegedly incorrect rate, the financial effect is felt from month to month. In appropriate cases, such a claim may involve a continuing wrong.

26. In Union of India and Others v. Tarsem Singh, (2008) 8 SCC 648, the Hon’ble Supreme Court explained the distinction between continuing service-related wrongs and stale claims. The Court recognized that relief in matters involving continuing wrongs may be granted while restricting arrears, ordinarily to a period of three years preceding the institution of proceedings, subject to the circumstances of the case.
27. In the present matters, the applicants seek correction of their pay position on the ground that they have been denied a scale granted to similarly situated employees. The claim, to the extent it concerns continuing incorrect pay fixation, cannot be rejected merely because the applicants did not approach the Court at the same time as the earlier successful litigants.
28. Nevertheless, the applicants cannot be permitted to claim unrestricted monetary arrears extending over several years merely because their pay fixation is now being examined. The question of delay must be balanced with the need to ensure that similarly situated employees are not treated differently.

29. We are therefore of the view that, where the applicants establish entitlement to the higher pay scale under the applicable rules and the earlier binding judgments, the benefit of pay fixation should be given from the date on which such entitlement arose, but the payment of actual arrears should be restricted to three years preceding the filing of the respective Original Applications.
30. We also make it clear that any benefit already lawfully granted to other employees shall not be disturbed merely because the present applicants have sought parity. Those employees are not required to lose their existing benefits for the applicants to receive relief.
31. The respondents are expected to act as fair employers. The department must ensure that employees who belong to the same category and satisfy the same eligibility conditions are treated alike. An employee should not be made to suffer merely because he or she did not approach the Court earlier, where the legal entitlement is otherwise established.
32. In view of the above discussion, we find that the applicants’ claims deserve relief to the extent that they are covered by the same statutory provisions and the same legal principle which formed the basis of the

benefits granted to the similarly situated employees under the earlier judgments.

Accordingly, both Original Applications are allowed in the following terms: a) The impugned orders bearing No. CEJ/KDM/Court/19 of 2021 dated 12.01.2021 and No. CEJ/Adm/Court/DPC/43 of 2022 dated 04.05.2022 are hereby quashed and set aside, insofar as they reject the applicants’ claims without properly addressing their asserted parity with the employees covered by the earlier judgments. b) The applicants shall be granted the benefit of the pre-revised pay scale of Rs. 220–430, together with corresponding revisions of pay, from the respective dates of their entitlement, provided they belong to the same category, satisfy the same statutory eligibility conditions and are covered by the principle laid down in the earlier Hon’ble High Court judgments relied upon in these proceedings. The respondents shall verify these objective particulars from the service records and the relevant

judgments. Such verification shall not be treated as an opportunity to reopen the legal issues already settled by those judgments. c) The respondents shall carry out the necessary pay fixation and grant all consequential service benefits arising therefrom, including revision of pensionary benefits, wherever applicable. d) The benefit of pay fixation for the period prior to the filing of the Original Applications shall be notional, except to the extent of admissible monetary arrears. e) Actual monetary arrears shall be restricted to a period of three years immediately preceding the filing of each respective Original Application (OJai Dev Gupta Vs. State of Himachal Pradesh, 1997. The applicants shall also be entitled to admissible monetary benefits for the period thereafter. f) The respondents shall complete the entire exercise and release the admissible benefits within a period of three months from the date of receipt of a certified copy of this order. g) The benefits already lawfully granted to the private respondents or other similarly situated employees shall not be disturbed

merely on account of the disposal of these Original Applications.
34. Before parting with the matter, we observe that public employment carries with it an obligation of fairness. Employees who have served the department for several years are entitled to expect that their service conditions will be governed by the same rules and applied in the same manner as those of their colleagues. Where the law recognises an entitlement, its benefit should not depend merely upon which employee was the first to approach the Court.
35. Both Original Applications stand disposed of in the above terms. There shall be no order as to costs.
36. Pending Miscellaneous Applications, if any, shall also stand disposed of.
