ORDER(Oral)

PER MR. RAJINDER SINGH DOGRA, MEMBER (J):

The applicant has moved this OA, seeking the following reliefs:

“(i) Directing the respondents to allow the applicant, who has already been selected and appointed as Multi Tasking Staff (orderly), in the Revenue Department, vide Government Order No. 195-JK(Rev) of 2022, dated 29.10.2022, issued by Respondent No. 1, to join on the said post.

(ii) Such other additional or alternate relief, which this Hon’ble Tribunal may, in the facts and circumstances of the case deem fit and proper, be also awarded in favour of the applicant.”

2. The brief facts of the case are that in the year, 2020, the Service Selection Board, issued an advertisement notification bearing No. 01 of 2020, inviting application forms from eligible candidates for the post of Multi Tasking Staff (Orderlies). The applicant being eligible for the said post applied for the same through online mode on 20-8-2020. The applicant alongwith other candidates were short listed for interview. The applicant and other candidates were interviewed by the Board. The Board after completing the selection process, issued the select list of a number of candidates including the applicant in the year 2022. Thereafter, the respondent No.

issued the appointment orders in favour of the applicant and 31 others, vide order dated 29-10-2022. At that time, the applicant was pursuing her Masters Degree Programme in Zoology from Jammu University. It is further submitted that in the month of January, 2022, the younger brother of the applicant also left for heavenly abode and the whole family including the applicant was in deep shock. In these circumstances, the applicant could not submit her joining within the stipulated period. The applicant completed her Masters degree in the month of May, 2023. Thereafter, the applicant approached the concerned authorities for submitting her joining. The applicant was told that the matter had been referred to higher authorities for relaxation of joining period. However, nothing was done in the matter. Thereafter, the applicant submitted a representation on 17-4-2025 to the respondent No. 3, requesting him to allow her to join on the post in question. However, no action whatsoever has been taken by it till date. Hence this OA.

3. Learned counsel for the applicant has fairly submitted that it would suffice applicant’s purpose if a direction be given to the respondents to consider the pending representation of the applicant within a stipulated timeframe.

4. Learned counsel for the respondents has no objection to such proposition.

5. Heard the parties.

6. In view of the above, respondents are hereby directed to consider the pending representation dated 17.04.2025 of the applicant by treating the instant OA as a part of it and consider the case of applicant for allowing him to join to the post of MTS(Orderly) in the Revenue Department, by passing a reasoned and speaking order within a period of six weeks from the date of receipt of a certified copy of this Order.

7. Accordingly, OA stands disposed of. No costs.

8. Pending M.As, if any, also stand disposed of.
