1. The respondent no.1 filed Original Application bearing T.A. No. 134412023 titled as Invent Assets Securitization & Reconstruction Private Limited & others v. M/s Gold Star International & others which was stated to be pending before the DRT-II, Delhi. The appellants were impleaded as defendarts no. I and 2 in the Original Application.
2. The DRT-II, Delhi vide final order dated 18.06.2.i,?6 has finally decided the OA and accordingly passed the decree. Sh. Gautam Singhal, Counsel for the appellants stated that the appellants were proceeded exparte and for setting aside exparte order they have already filed M.A. bearing No. 17212026 which is still pending before DRT-II, Delhi for consideration.
3. After brief arguments, Sh. Gautam Singhal, Counsel for the appellants seeks permission to withdraw the present appeal but with the liberly to :evival of the appeal in case of altered circumstances, more particularly, if h4.A. bearing No.17212026 is decided against the appellants.
